These Terms of Service ("Terms") govern your use of the Hey Mixi application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
You agree to use the App only for lawful purposes and in a manner consistent with these Terms and any applicable laws or regulations. You acknowledge and agree that the App is subject to the Spotify Terms and Conditions of Use and Spotify Privacy Policy, which can be found at https://www.spotify.com/legal/.
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Wildlife Design Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You acknowledge and agree that the App builds playlists using artists who have copyrighted materials, and that the App is subject to the copyright protection of those artists. You agree to use the App in a manner that respects the copyright of all artists and to comply with all applicable copyright laws.
The App is provided "as is" and "as available" without any representations or warranties of any kind, express or implied. Wildlife Design Inc. makes no representations or warranties of any kind, express or implied, as to the operation or availability of the App, or the information, content, materials, or functionality included in the App.
In no event shall Wildlife Design Inc., its affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use or inability to use the App.
You agree to defend, indemnify, and hold harmless Wildlife Design Inc., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
Hey Mixi reserves the right to modify or discontinue, temporarily or permanently, the App (or any part thereof) with or without notice. Wildlife Design Inc. may also modify these Terms from time to time, and your continued use of the App after such modifications shall signify your agreement to be bound by the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
These Terms constitute the entire agreement between you and Wildlife Design Inc. with respect to the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you andWildlife Design Inc. with respect to the App.
